Q1. Atty. Batu, magkano ba ang fine per year kung hindi kaagad nabayaran ang capital gain tax at hindi pa rin napare-register ang deed of sale or documentary stamp tax?
00:29.4
All right. Yes actually meron talaga tayong mga penalties kapag hindi natin nabayaran ng capital gain tax and documentary stamp tax in a sale transaction. Importante po ito na dapat kailangan ano ito siya mabayaran natin.
00:59.4
So supposing bumili ka ng property worth P3M today, and then quick recap, ano ba yung babayaran natin kapag bumili tayo? So of course we will pay capital gain tax 6%. Alam niyo na ito po, meron ito dapat itong bayaran within 30 days from the date of notarization.
01:25.4
So kung napetsahan ninyo ano bang araw ngayon is February 4. So dapat February 4, March 2 dapat mabayaran ang capital gain tax. 30 days lang kasi. And after that bayaran natin ng documentary stamp tax na 1.5%.
01:45.4
Yung documentary stamp tax lang po is dapat bayaran siya every 5th day of the month. Kaya karamihan ng non-notaryo ng mga dokumento, ng mga sale transaction, ang ginagawa nila including donation, is pidepecha nila ng 6 para hindi na sila magkaroon ng problema doon sa every 5th day of the month ang documentary stamp tax.
02:11.4
So isang takbo talaga is meron siyang takbo na 130 days na hindi siya possibly ma-penalty sa capital gain tax and documentary stamp tax para makahabol. Kasi maraming mga documentary requirements needed.
02:27.4
So yan ang ginagawa nila. So if we will compute it, magkano ba? Okay, let's study. Number 1, so ang basic taxes po kailangan natin for capital gain tax na 6% is P180,000. Okay.
02:41.4
And then kung sa documentary stamp tax po is 1.5%, that would be P45,000. Base po yun doon sa P3,000,000 na tax base natin. Assuming yan ang tax base natin. Alright, so a total po nya would be P225,000.
03:00.4
So yan dapat ang tax na binayaran mo today kung sakaling binilim mo yung property today and you have 30 days within which to pay that. Problem is, ang tanong ni Finaymind is that eh paano kung hindi nabayaran ito?
03:14.4
At may hawak na sila ng deed of sale. For example, we will give an example na 5 taon nang hindi nababayaran. Ang tagal na yan. So magkano po bang babayaran natin na taxes and penalties and fines?
03:28.4
Alright, under the Bureau of Internal Revenue, so a National Internal Revenue Code, may mga penalties po tayo. And the penalties number 1 would be an interest at 20%. Okay.
03:44.4
Base po yun doon sa unpaid tax natin na P225,000. So interest 20%. Bakit same, P225,000? Kasi 20% times P225,000 times 5 years. Kasi 5 taon eh, hindi ka nakabayad.
04:02.4
Ibig sabihin, ang interest niyan is for 5 years, that is total of P225,000. Okay. And then mayroon din tayong babayaran na compromise penalty. Ang compromise penalty po natin is P20,000. Bakit po?
04:19.4
Kasi merong bracket na between 1,000 to 50,000 ang babayaran. Meron silang bracket. This bracket ito. Ito yung amount of compromise if the amount of tax unpaid is within this bracket.
04:34.4
So sa atin, dahil P225,000 yung dapat bayaran natin, dito tayo nabilong. Okay. So between 100,000 to 500,000, so P20,000 ang compromise penalty natin. Yan.
04:49.4
Oh, hindi pa lang tatapos. So meron ba tayong surcharge na 25%. One time lang naman po ito. So that is P56,250. And then it is a one time payment as I said. So ang total po na penalties through by way of interest, compromise and surcharge 25% is P301,250.
05:17.4
So if you notice, ang nakapataas dito yung interest na 20% per annum per year kasi. Alright. So if we will try to total that with the basic taxes natin. Kasi bakit kailangan, bayaran mo pa rin yung basic taxes na P225. Yung na-compute natin kanina na 6% and 1.5%.
05:35.4
So ang total po na payable na basic tax plus interest, compromise, surcharge is P526,250. Laki. So kaya nga, pay taxes during the deadline para, within the deadline para hindi po tayo magkaroon nitong interest, compromise at surcharge po. Malaki po ating bayaran.
06:02.4
So I hope I answered your question Pinay Mind. And yeah, it would be a great thing that you should avoid these things. So dapat pag nan-authorize, kasi kaso ka agad. Payad ka agad.
06:17.4
Alright. So with that, I can.
